Welcome to Ghibli art Al ("we," "us," or "the Service"). By accessing our website, creating an account via Google, or purchasing credits through Creem, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.

If you do not agree to these Terms, you must not access or use the Service.

2Accounts and Eligibility

2.1 Age Requirement: You must be at least 18 years old to use this Service. If you are under 18, you may only use the Service with the permission and supervision of a parent or legal guardian.
2.2 Account Security: We use Google OAuth for authentication. You are responsible for maintaining the security of your Google account. We are not liable for any loss or damage arising from your failure to protect your account credentials.
2.3 Termination: We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

3Payment and Refund Policy

3.1 Payment Processor: All financial transactions are processed by our third-party partner, Creem. We do not store or process your credit card details on our servers. By making a purchase, you agree to comply with Creem’s terms and conditions.
3.2 Virtual Goods: Purchases of "Credits," "Tokens," or "Subscriptions" are licenses to use digital features and have no monetary value outside of our Service.
3.3 No Refund Policy:
- All sales are final. Because the Service offers immediate access to digital goods (AI generation credits), we do not offer refunds once the credits have been delivered to your account.
- Exceptions: In the event of a persistent technical error preventing the Service from functioning for an extended period (e.g., >24 hours), you may contact us for a potential refund or credit compensation, subject to our sole discretion.
- Disputes: You agree to contact us via email to resolve any payment disputes before initiating a chargeback with your bank or Creem.

4Intellectual Property and Content

4.1 User Content

You retain ownership of the original images you upload and the text prompts you input. You represent and warrant that you have the necessary rights to use such content and that it does not infringe upon the rights of any third party.

4.2 AI-Generated Content

Subject to your compliance with these Terms, you own the images you generate using the Service. You are free to use them for personal or commercial purposes.
No Exclusivity: Due to the nature of AI, we cannot guarantee that the generated images will be unique. Other users may generate similar images using similar prompts.

4.3 Disclaimer Regarding Art Styles (Important)

The Service provides AI-driven artistic filters and generation capabilities (e.g., "Anime Style," "Fantasy Art"). These styles are algorithmic simulations.
We are not affiliated, associated, authorized, endorsed by, or in any way officially connected with Studio Ghibli (株式会社吉卜力工作室), Hayao Miyazaki, or any of their subsidiaries or affiliates.
You agree not to use the Service to intentionally infringe upon the trademarks or copyrights of Studio Ghibli or other third parties (e.g., by generating and selling exact replicas of copyrighted characters).

5Prohibited Conduct

You agree not to use the Service to generate, upload, or share content that:

Is illegal, harmful, threatening, abusive, harassment, defamatory, vulgar, obscene, or invasive of another's privacy.
Depicts sexual violence or non-consensual sexual content.
Contains Child Sexual Abuse Material (CSAM). We report all CSAM to relevant authorities immediately.
Infringes on any patent, trademark, trade secret, copyright, or other proprietary rights of any party.
Creates "Deepfakes" intended to deceive, defraud, or defame real persons.

6Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

AI Unpredictability: Artificial Intelligence may produce artifacts, errors, or unexpected results. We do not guarantee that the generated images will be accurate, high-quality, or suitable for your specific needs.
Service Availability: We do not guarantee that the Service will be uninterrupted, secure, or error-free. The Service relies on third-party APIs and cloud hosting (e.g., Railway) which may experience downtime.

7Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.
